Assault Victim Wins Significant Damages for Injuries and Losses

Austin Paladeau and Kay Decker were successful in representing a young woman who was violently assaulted in 2017. She suffered serious and life altering injuries as a result of the defendant. She was awarded $100,000 for her pain and suffering, plus amounts for her future care and housekeeping.

The Court stated that she had limited earning potential before the assault occurred but had suffered further “diminution in her earning capacity” from the assault. The Court quantified the loss at a total of $300,000 — a precedent-setting award for such a loss and injury.

The case presented procedural challenges for our client in obtaining judgment against the defendant. Austin and Kay navigated through those challenges to obtain the necessary evidence and prove her losses, advocating on her behalf in the Court of Queen’s Bench of Alberta.
